Even captured courts will not allow the Constitution Amendment Bill to escape a referendum

Constitutional lawyer Professor Lovemore Madhuku insists that the Constitution Amendment Bill No. 3 cannot escape a referendum even before Zimbabwe's courts. He argues that while courts can be captured there is always a minimum standard below which they cannot go, and that no court can legally agree that the proposed term extension does not require a referendum. He explains that Section 328 of the Constitution specifically prevents a sitting president from benefiting from a term extension during their tenure, and that the proposed shift from direct presidential elections to parliamentary selection makes the referendum requirement even more unavoidable.
